Two rows for two eras. The OP was created by the Frente Popular administration in 1989 and has never been written into law as a process: the municipal charter of 1990 requires popular participation in the budget (the council's purpose cites its article 116) without saying how, the rules live in the Regimento Interno that the council and the government approve together each year, and the budget still goes to the Câmara as the mayor's proposal. Santos records that in the 1990s the founders refused legalisation on purpose, to keep the process out of the legislature's hands, and that the mayor's veto over council resolutions was never used; Baiocchi notes the Câmara never significantly altered an OP budget. In that era the formal-not-legal mandate was binding in practice: the City executed on average 96 percent of the demands up to 2000 and published an investment-plan booklet each year. The second row is the mandate as it stands since 2005 and especially since 2017: resolutions can be vetoed by the executive (the override needed two thirds in 2005, half since 2023), the mayor paused the assemblies in 2017 with the council's assent, the Câmara approved an electronic OP in 2021 without consulting the council, and execution fell to 36 percent in 2005 to 2008 and under 1 percent of the amounts budgeted for 2013 to 2017. The council did win one piece of ground in December 2012, when the cycle was aligned with the budget-guidelines and budget laws so that the plan is written into the budget law. Scope today is mixed: regions choose among 20 themes and rank their own works, but every theme carries a list of eligible demand types and departmental technical criteria, and the pot is fixed by the City before the cycle.
