The scheme began as a campaign commitment of Anne Hidalgo (a permanent budgetary dialogue with Parisians) and a vœu of the Conseil de Paris in May 2014 that fixed the 5% and the two territorial levels; the first vote, in September 2014, was on 15 projects drafted by the City's elected officials and departments. From 2015 it runs under a charter adopted unanimously by the Conseil de Paris in November 2014, amended by vœu and deliberation in December 2015, rewritten in February 2021 (2021 DDCT 8) and again in November 2022 (2022 DDCT 103). The charter is a council deliberation, not a statute, so it can be rewritten by the same majority, and the audit notes that some rules (admissibility criteria, the quartiers populaires perimeter) were changed by the executive's steering committee without the council. The City commits in the charter to respect the vote and realise the winning projects, except in case of particular hazards, and the audit confirms that every year the amounts voted by Parisians were matched by authorisations of programme voted in December, which it calls the decisional character of the scheme; the gate is procedural. Within the pot residents choose freely, but the ballot is settled by the City: ideas must pass admissibility (general interest, City competence, investment spending, few running costs, since 2023 compatible with climate and solidarity objectives) and technical feasibility, since 2018 cannot be heavy public-space works, may be grouped under one title, and the borough hall or the Mayor fixes the list after the commission; in 2021 and 2022 the Tout Paris level was themed. Abandonment after studies (28 projects by 2019, 65 by 2025 in the open data) and the rare rework of a project rejected by neighbours are the known limits of the commitment. The opposition-run 17e abstained on the 2021 charter and voted a vœu against including road maintenance, and questioned the legitimacy of a vote open to anyone with a carte citoyenne.
